It is your responsibility to report and pay any taxes that may arise from entering into a Transaction using Bitexia Services, and you acknowledge that Bitexia does not provide legal or tax advice regarding these transactions. If you have any doubts about your tax position or obligations regarding your use of Bitexia Services or Digital Assets held as credit in your Bitexia account, you are advised to seek independent advice.
You agree that Bitexia will report information about your transactions, transfers, distributions, or payments to tax or other public authorities when, where, and as required by Applicable Law. Similarly, Bitexia will withhold taxes from your transactions, transfers, distributions, or payments when, where, and as required by Applicable Law. You are advised to seek professional and personal tax advice before making any Transaction.
Market Risks
Investment in Digital Assets carries significant risks:

- You may lose all or part of your investment and may not get back the amount invested

Similarly, the sustainability of Digital Asset networks can be affected by various factors, all of which can impact a Digital Asset’s value.
Counterparty Risk
You may be exposed to counterparty risk when using Bitexia Services, including but not limited to:
- Market makers or liquidity providers experiencing issues
- Payment processor failures or disputes
- Borrowers defaulting on repayment obligations

You are solely responsible for determining whether any investment, investment strategy, or related transaction is appropriate for you based on your personal investment objectives, financial circumstances, and risk tolerance.
Fees and Expenses
Bitexia may update fees and expenses from time to time at its discretion. Please be aware of all applicable fees and expenses, as these will affect the returns you obtain from using Bitexia Services.
Availability Risk
While we aim to provide a seamless user experience, we cannot guarantee that Bitexia Services will be available at any particular time or that Bitexia Services will not be subject to unplanned service interruptions or network congestion. You may not be able to purchase, sell, transfer, send, or receive Digital Assets at your desired time.
Regional Restrictions
Various countries have legal requirements that may restrict the products and services Bitexia can legally provide. Accordingly, certain products and services and/or specific functions within the Platform, including but not limited to fiat currency services, may be unavailable or restricted in certain jurisdictions or regions or for certain Users, and any Bitexia campaigns, user contests, or other promotions will not be open to (and are not targeted or intended for) Users subject to restrictions.
Users are responsible for informing themselves about and complying with any restrictions and/or requirements imposed regarding access to and use of the Platform and Bitexia Services in each jurisdiction from or on behalf of which the Platform and Bitexia Services are accessed by the User. Bitexia reserves the right to modify such restrictions or impose additional restrictions regarding access to and use of the Platform and/or Bitexia Services from time to time at its discretion and may be unable to provide notice.
Third-Party Risk
Third parties such as payment providers, custodians, and banking partners may be involved in providing Bitexia Services. You may be subject to these third parties’ terms and conditions. Unless expressly stated otherwise, Bitexia will not be responsible for any losses resulting from or arising out of services provided by such third parties.
Security Risk
The nature of Digital Assets exposes them to increased risk of cyber attacks. While Bitexia makes all reasonable efforts to protect Digital Assets and protect the Platform from cyber attacks, it is impossible for any exchange to completely eliminate security risks. There can be no guarantee that systems implemented to reduce cyber security threats will always be effective in preventing improper access to the Platform and Digital Assets.
You are responsible for keeping your Bitexia Account information secure and will be responsible for all Transactions in your Bitexia Account, whether authorized by you or not. Transactions in Digital Assets may be irreversible, and losses from fraudulent or unauthorized transactions may not be recoverable.
Digital Asset Risks
Due to the nature of Digital Assets and their underlying technologies, there are several inherent risks, including but not limited to:
Technical Risks
- Failures, defects, attacks, exploits, errors, protocol failures, or unforeseen circumstances relating to Digital Assets or their underlying technologies
- Irreversibility of Digital Asset transactions, resulting in unrecoverable losses from fraudulent or accidental transactions
- Technological developments leading to obsolescence of the Digital Asset
- Network delays preventing transactions from completing on intended delivery dates
- Attacks on the protocol or technologies underlying the Digital Asset
Network and Protocol Risks
- Hard forks may occur if Digital Asset developers propose changes to software and sufficient users and miners do not upgrade
- Blockchain network addresses holding significant amounts of assets may cause volatility if positions are liquidated
- Potential “51% attacks” if anyone gains control of more than 51% of a blockchain network’s computing power
- Fraud or cyber attack risks
- Digital Assets purchased and held in an account at Bitexia are not covered by external investor compensation, client asset protection, deposit protection, insurance, or other similar schemes
Market Monitoring
Digital Asset markets are open 24 hours a day, 7 days a week. Rapid price changes can occur at any time, including outside normal business hours.
Communication Risks
When communicating with us via electronic communication, you should be aware that electronic communication may fail, be delayed, be insecure, and/or not reach the intended destination.
Currency Risk
Fluctuations in exchange rates may affect your gains and losses.

Digital Assets may not be considered “property” under Applicable Laws in some jurisdictions. This may affect the nature and enforceability of your interest in Digital Assets.
Legal and regulatory changes may adversely affect or restrict the use, transfer, exchange, and value of Digital Assets and the provision of Bitexia Services in certain jurisdictions. Legal and regulatory changes can occur rapidly and without prior notice.
